1. Definitions
- "We", "Us", "Our" — Escapement Row, the watch repair workshop at the address above.
- "You", "Client", "Owner" — the individual or entity engaging our services or using our website.
- "Services" — watch repair, service, restoration and related technical work as described on our website and in written quotations.
- "Timepiece" — the watch, clock or movement entrusted to us for Service.
- "Agreement" — these Terms & Conditions together with any written scope or quotation issued by us and accepted by you.
2. Acceptance of Terms
By submitting an enquiry form, dropping off a Timepiece at our workshop, or otherwise engaging our Services, you confirm that you have read, understood and agree to these Terms. You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you are submitting a Timepiece on behalf of another party, you confirm you have authority to do so.
3. Service Description
We offer three principal services: (a) Mechanical Movement Overhaul, (b) Water Resistance Testing and Gasket Renewal, and (c) Heritage Timepiece Restoration. Full descriptions are available on our Solutions page. Services are performed at our Kuala Lumpur workshop. We do not currently operate satellite locations.
All bench work is carried out by our own watchmakers. We do not sub-contract movement work without informing you in advance.
4. Scope and Parts Approval
Before commencing work, we will provide a written condition report and quotation. The quotation covers bench time and standard consumables. Any worn or damaged parts requiring replacement will be itemised separately and communicated to you for approval before ordering.
Work will not begin on parts replacement until written approval is received. If you decline a recommended replacement, we will proceed with the agreed scope and note the declined items on the job card. We accept no liability for performance issues arising from parts you have declined to replace.
If, during disassembly, we discover conditions that materially change the scope or cost, we will pause work and contact you before proceeding.
5. Payment Terms
All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise. Payment is due in full upon collection of the Timepiece. We accept cash, bank transfer and major debit/credit cards.
We reserve the right to retain the Timepiece until full payment is received. If a Timepiece is not collected within 90 days of completion notice, a storage fee of RM 20 per week may be applied after the first 30 days.
Cancellation
If you cancel a commission after work has begun, you are responsible for bench time incurred to the point of cancellation, plus the cost of any parts already ordered with your approval. We will provide a final statement of work completed before requesting payment on cancellation.
6. Timelines
Quoted timelines are estimates. Standard turnaround for water resistance services is two to four working days. Mechanical overhauls typically take three to five weeks. Heritage restoration commissions run three to six months. Timelines may extend where parts sourcing is required; we will notify you of any significant delay.
We are not liable for losses arising from delays outside our control, including parts delivery delays, public holidays or force majeure events.
7. Intellectual Property
All content on our website — text, photographs, design elements and technical documentation — is owned by Escapement Row or licensed to us. You may not reproduce, distribute or adapt our content without written permission.
Photographs taken of your Timepiece for condition documentation remain your property. We may use anonymised or cropped images for portfolio and educational purposes unless you object in writing at intake.
8. Limitation of Liability
We take every reasonable precaution with Timepieces in our care and carry trade insurance covering items in progress. In the event of loss or damage caused by our negligence, our liability is limited to the lower of: (a) the assessed market value of the Timepiece at the time of loss, or (b) RM 30,000.
We are not liable for pre-existing faults that were not identified at intake, for normal ageing of components, or for loss of use during the service period. We are not liable for indirect or consequential losses.
Nothing in these Terms excludes liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under Malaysian consumer protection law.
9. Disclaimers
Watch servicing improves the mechanical condition of a movement but does not restore it to new. Rates achieved after service reflect the calibre's current state, component wear history and design specifications. We do not offer any representation about the long-term rate performance of any Timepiece.
Information on our website is provided for general reference. It does not constitute technical advice for specific movements not inspected by us.
10. Indemnification
You agree to indemnify Escapement Row against any claims, losses or costs arising from your breach of these Terms, your misrepresentation of ownership or authority, or your misuse of our website.
11. Termination
Either party may terminate a service agreement by written notice. If we terminate, we will return the Timepiece in its current state and invoice for work completed. If you terminate, you remain responsible for costs incurred to that point. Provisions relating to payment, limitation of liability and dispute resolution survive termination.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to attempt informal resolution first by contacting us at [email protected]. If informal resolution is not reached within 30 days, either party may refer the matter to the courts of Kuala Lumpur, Malaysia, which shall have exclusive jurisdiction.
Consumer disputes may also be referred to the Consumer Tribunal Malaysia (Tribunal Tuntutan Pengguna Malaysia) for matters within its jurisdiction.
13. General Provisions
- Entire Agreement: These Terms, together with any written scope or quotation, constitute the entire agreement between the parties on the subject matter.
- Severability: If any provision is found unenforceable, the remaining provisions remain in force.
- Waiver: Failure to enforce any provision does not waive the right to enforce it in future.
- Assignment: You may not assign your rights under these Terms without our prior written consent.
- Notices: Written communications should be sent to our workshop address or to [email protected].
14. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on this page with a revised date. Changes do not apply retroactively to commissions already in progress. Continued use of our services after an update constitutes acceptance of the revised Terms.
